Terms of Service

These Terms of Service ("Terms") govern your use of Voicesmith, a text-to-voice studio operated by Füüsika projektid ("we", "us", the "Seller"). By creating an account or continuing to use the service, you agree to these Terms. You are contracting with Füüsika projektid, reachable at business@mishazujev.com.

1. The service

Voicesmith converts text you provide into synthesized speech audio (MP3) using artificial intelligence. You can control characteristics such as language, voice, age, tone, pitch, speed and richness. New accounts receive a free allowance of audio generation time; additional usage requires a paid subscription or a one-off credit pack.

2. Accounts

• You must provide accurate information and keep it up to date.
• You are responsible for keeping your login credentials confidential and for all activity under your account.
• You must be of legal age in your jurisdiction to purchase a paid plan.

3. Acceptable use

You must not misuse the service. In particular, you must not:

• Use the service for any unlawful purpose, fraud, or spam.
• Generate audio that infringes intellectual property rights, impersonates a real person without their consent, or constitutes a deceptive deepfake.
• Generate hate speech, harassment, or content sexualizing minors.
• Interfere with the service's security, including introducing malware, probing, scraping, or attempting to circumvent usage limits or quotas.
• Reverse engineer, resell, or redistribute the service itself.

You are responsible for the text you submit, for having the rights to that content, for how you use the generated audio, and for verifying that outputs are suitable for your purpose. AI-generated audio may be inaccurate or unsuitable for regulated professional use without human oversight.

4. Intellectual property

We retain all ownership of the service and its intellectual property, including software, documentation and branding. We grant you a limited, non-exclusive, non-transferable right to use the service within your selected plan. Subject to these Terms and the rights of any underlying text you provide, you may use the audio you generate for your own purposes, including commercial use. You grant us a limited license to host and process your text solely to provide the service.

If you believe generated content infringes your rights, contact us at business@mishazujev.com with details and we will review and remove infringing material where appropriate. Repeated infringement may result in account termination.

5. Payments, subscriptions and refunds

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation and refund mechanics are governed by Paddle's Buyer Terms. Subscriptions renew monthly until cancelled; you can cancel at any time and retain access until the end of the paid period. Credit packs are one-off purchases that do not expire.

6. Service level

We do not guarantee uninterrupted or error-free operation. The service is provided "as is" and we disclaim all implied warranties, including merchantability and fitness for a particular purpose, to the fullest extent permitted by law.

7. Content moderation and suspension

We may remove or restrict content, refuse or filter outputs, and suspend or terminate access for material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations.

8. Liability

To the fullest extent permitted by law, we are not liable for indirect, consequential or special damages (including loss of profits, data or goodwill), and our aggregate liability is capped at the fees you paid in the 12 months preceding the claim. Nothing in these Terms excludes liability for fraud, death or personal injury where such exclusion is not permitted by law.
